Eligibility: NO PURCHASE NECESSARY TO ENTER OR WIN. Employees, officers, and directors (including immediate family members and members of the same household) of By the Yard, and each of its affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Drawing are not eligible to participate. The Drawing is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted.
How to Enter: Complete the on-line Contest Entry Form ("Entry Form") available through By the Yards home page at www.bytheyard.net and submit it by selecting the SUBMIT button at the bottom of the Entry Form page. Limit one (1) entry per person per contest period (see schedule below). By the Yard is not responsible for any data entry errors or computer miscues that result in By the Yard not receiving an Entry Form. All entries become the property of By the Yard Inc.
Random Drawing: By the Yard will award three (3) $1,000.00 prize packages of Maintenance-free Outdoor Furniture in 2009. The winners of the Drawings (the "Winners") will be selected by random drawing on or about; April 30, 2009; June 30, 2009 and September 30, 2009 from all eligible Entry Forms. By the Yard decisions are final and binding on all matters relating to these Drawings. Odds of winning depend on the total number of eligible Entry Forms received. All prizes will be awarded. Limit one prize annually per person.
Contest Periods: All entries received 12:00 am January 1, 2009 through April 29, 11:59 pm will be eligible for the random drawing held on or about April 30, 2009. All entries will be deleted from the contest proceeding the random selection of a winner. The winner is fully responsible for any and all applicable federal, state, international and local taxes. All costs and expenses not specified herein, related to the prize, including but not limited to lodging, transportation costs, meals, taxes (including income taxes) and gratuities and other expenses incurred by accepting the prize are the sole responsibility of the Winner.
The prize is non-transferable and non-assignable, with no cash redemptions or substitutions. By the Yard will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disasters outside its control that may affect the Winner\\\\\\\\\\\\\\\'s usage of the prize.
Notification: The Winner will be notified by telephone and US mail within 24 hours of the Drawing and has 30 days to contact By the Yard to claim their prize.
By participating in the Drawing and submitting an Entry Form, all entrants agree to be bound by these Official Rules. By entering the Drawing, each Winner agrees to waive any and all claims against By the Yard, and its agents and representatives for any injury, damage or loss that may occur from the participation in the Drawing or from the receipt or use of any prize or travel related to the receipt or use of any prize.
By the Yard and its agents and representatives are not responsible for printing or typographical errors in any Drawing-related materials, late or misdirected entries, lost, illegible, delayed, misdirected, damaged, incomplete entries. By the Yard and its respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of Entry Form or prize reply information, or for any technical or human errors associated with the Drawing. If, in By the Yard\\\\\\\\\\\\\\\'s exclusive judgement, these Drawings become compromised in any way, By the Yard reserves the right to withdraw the Drawings offer, and void any entries submitted fraudulently or select winners from all eligible entries prior to the act that compromised the drawing.
By the Yard reserves the right, in its sole discretion, to cancel or suspend the Drawing should virus, bugs, unauthorized human intervention, or other causes beyond the control of By the Yard corrupt administration, security, fairness, integrity or proper operation of the Drawing. In the event of cancellation, By the Yard may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the Drawing at the time of such cancellation. Any attempt to deliberately damage the content or operation of the Drawing is unlawful and subject to legal action by By the Yard or its agents. By the Yard shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Drawing, and to resolve all disputes at its sole discretion. By the Yard (i) makes no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaims any implied warranty. All disputes will be resolved under applicable U.S. laws in the state of Minnesota.
